Main Reasons for D-10 Internship Report Rejection
1. Failure to Meet Requirements for Foreign Nationals or Companies
Internship reports may be rejected if the foreign national does not meet the eligibility criteria or the company does not fulfill the necessary hiring conditions.
✅ Eligibility Criteria for Foreign Nationals
- Must be a registered foreigner holding a general job-seeking visa and engaging in internship activities within a field classified under Professor (E-1) to Specific Activities (E-7) or seeking to change affiliations.
- Foreigners who previously worked in a professional occupation (E-1 to E-7) and switched to a D-10-1 visa are not eligible for internships.
✅ Company Requirements
- Employment contracts must ensure a wage that meets or exceeds minimum hourly wage standards.
- The position must be in a professional field (E-1 to E-7); simple part-time work is not eligible for internship hiring.
2. Rejection Due to Internship Abuse
If a company hired foreign interns within the past six months but failed to convert them into full-time employees, new internship reports may be denied.
🚨 Internship abuse restrictions:
- If no interns were hired as full-time employees, and
- If the number of foreign interns who were not converted to full-time positions exceeds 10% of the company’s total workforce (including foreign employees) (for companies with fewer than 10 employees, the threshold is 20%),
- The internship report will be rejected.
Note: This applies regardless of whether the previous interns resigned voluntarily or were dismissed. There is no grace period for companies facing this restriction.
3. Exceeding the Six-Month Limit at the Same Company
If a D-10 visa holder completes a total of six months of internship at the same company, they are not eligible for further internship extensions.
Employers must manage internship durations carefully to avoid report rejection.
Key Precautions for Companies
✔️ Verify the D-10 visa holder’s eligibility before hiring them as an intern.
✔️ Consider the possibility of full-time conversion when planning internship recruitment.
✔️ Review recent internship hiring records to ensure compliance with the internship abuse restrictions (10-20% rule for past six months).
✔️ Be aware that interns who have worked for six months at the same company cannot extend their internship.
