Handling Foreign Worker Termination: Follow These Steps for a Smooth Process

 

When a foreign worker leaves your company or when changes occur in employment conditions, there are important legal procedures to follow.

1. When Should You Report It?

 

Employers are required to report under the following conditions:

  • Dismissal, voluntary resignation, or changes in employment contracts: Report within 15 days of the event.
  • Death or unknown whereabouts: Report within 15 days of knowing the event.
  • Missed the reporting deadline? In this case, you’ll need to visit the local immigration office in person.

     

Good news: If the worker’s departure is due to the natural expiration of a contract, you don’t need to report it. 

However, if the worker plans to move to another job, be sure to check any additional steps required.

 

2. A Transfer Agreement Form Is Necessary for Job Transfers

 

If a foreign worker wishes to transfer to a new workplace after leaving, the employer must provide a 이적동의서 양식.docx

This document is essential for the worker to start a new employment contract without any issues.

Be thorough to ensure a smooth transition for the worker!

 

3. How to Submit the Report
 

Submit by Fax

  • Fax Number: The same nationwide number applies ☎ 1577-1346 (no area code needed)
  • Submission Hours: Monday to Friday (excluding holidays) 9:00 AM - 6:00 PM

Don’t Forget to Confirm Receipt

After sending the fax, confirm whether it was successfully received.

  • How to confirm: Call the 1345 Immigration Contact Center and provide them with the sending fax number for quicker verification.
     

4. Documents Required for Reporting
 

Prepare the following documents when reporting:

  • Foreign Worker Change of Employment/Training Report Form
  • Copy of the worker’s foreign registration card
  • Copy of the employer’s business registration certificate
  • Copy of the employer’s ID
  • (If applicable) Evidence supporting the reason for the change
     

5. What Happens After Submission?
 

  • The immigration office will review the submitted documents.
  • Additional documents may be requested during the review, so keep an eye out for any updates.
